Before proceeding with any purchase from this site, we ask that you read the following Terms and Conditions of Sale. They form part of the contract between you and Wizard Models Limited. Whilst they may seem heavy handed or legalistic, they are not substantively different from the standard Terms & Conditions of Sale applicable to goods sold by Wizard Models Limited elsewhere, nor for that matter any other retailer in the UK. They conform to the Consumer Rights Act 2015.
Please note nothing contained in the following sections or elsewhere on this site affects your statutory rights as a consumer, identified in the above or other pertinent legislation.
Any goods offered for sale on these pages are just that, offers. Any offers are ‘Errors and Omissions Excepted’ (E & OE). We reserve the right to amend details of products as required. If there is an incorrectly described or priced item then Wizard Models Limited reserves the right to refuse to supply that item. Prices are those ruling at the time of ordering.
Wizard Models Limited reserves the right to decline to trade with any person or organisation. We undertake to inform any such person or organisation within one working day of the decision to refuse to supply. We will not give grounds for refusal nor will we enter into any correspondence concerning the matter.
VAT: Wizard Models Limited is VAT registered (number GB 911 3584 42). For convenience, both VAT inclusive and exclusive prices are initially shown. Non-UK customers will automatically pay the VAT exclusive prices once the destination country has been set. However, you are responsible for paying any customs duty or local sales tax upon arrival in your country. Your refusal to pay these charges (the amount of which we cannot inform you of in advance) and the goods subsequently being returned to us will not entitle you to a refund. Should you require the order delivering to another person in your country, then they will need to pay these charges, and it is your responsibility to warn them of this.
Delivery Charges: Post and packing is charged on top of the cited prices. Orders to UK customers (including BFPO, IoM and Channel Islands) are sent by Royal Mail Signed For First Class post, and are charged at £5.40 per order, regardless of size or weight. Orders outside the UK are sent using Royal Mail’s Tracked & Signed Air Mail service which generally takes between 3 and 10 calendar days (but note that your order may then be delayed in your country’s Customs). It is charged at £0.75 plus the cost of postage, subject to a minimum charge of £5.40 and a maximum of £27.00. Because of the way online credit card orders are processed, £27.00 is added to all overseas orders when you check out. Your payment is then adjusted for the difference between this notional amount and the actual cost when we pack and weigh your order. The tracking number is usually available 3-4 days after posting; please e-mail us if you would like it. Overseas customers choosing to have their order sent on by a UK forwarding agent should note that we accept no responsibility for any loss or damage to your order after it arrives at the forwarding agent. All orders require a signature on receipt, or collection from your local post office if you are out. If you do not do this in time and the item is returned to us, then the postage charges will need to be paid again.
Payment: Payment by Visa, MasterCard, American Express, Delta, Maestro, Electron, Diners Club or Discover should normally made on the website via our payment agent Opayo. You may also send your card details by post or phone (NEVER VIA E-MAIL OR VOICEMAIL). Details must include the card number, expiry date, issue number or start date, signature strip security code and the account holder’s name and address; also give the delivery address if this is different. We no longer accept cheques or Postal Orders as a means of payment. All payments however made must be in UK Sterling. UK customers may also pay by BACS transfer.
All goods supplied remain the property of Wizard Models Limited until paid for in full.
Despatch: Orders are usually processed on the day of receipt, and despatched on Mondays and Thursdays. However, we may be out of stock of a particular item, which does happen occasionally. Such items will be sent at a later date, and you will only be charged once for postage. Please note we do NOT charge cards until at least two-thirds of the order (by value) is ready for despatch, unless you agree otherwise. If you provide a valid e-mail address or phone number with your order, we will undertake to inform you of any unusual problems or delays encountered prior to despatch. Please allow at least 21 calendar days for delivery, as Royal Mail does not regard items as “lost” until this period has elapsed.
Refunds: A statutory refund for or exchange of defective goods or goods supplied in error will be given provided they are returned undamaged within 28 calendar days of arrival. Wizard Models Limited will also refund reasonable return costs. The cost of goods ordered in error or now unwanted will also be refunded, but you are responsible for the cost of return. Refunds after 28 days (except in the case of faulty items) are at our discretion. Refunds will normally be made immediately upon receipt of the returned items. Please note that orders paid for by credit/debit card or BACS can only be refunded by a credit to the same account. Refunds may also be made by a credit note against future orders, at your discretion.
We endeavour to respond to any complaints or queries you may have within 5 working days; in practice, this is normally by return.
For the purposes of Trade Description, the advertised kits and components are not a toy and are considered unsuitable for persons under 14 years of age.
In the quest for improvement in quality and supply, specification may occasionally change without prior notice. For some products, the latest version of the instruction sheet may be downloaded from the website – check the appropriate product information page.
Data Protection Act/General Data Protection Regulation: By making an enquiry or placing an order, you are giving your consent for us to contact you by whatever means to further that enquiry or order. We will also enter your name, address, phone number and e-mail address (but not card details) into our customer database. Please state if you have any objections to this. Any other information recorded electronically is deleted once the order has been despatched. All paper records are disposed of securely once no longer required for tax or insurance purposes. Should you require the order delivering to another person, please note that they will receive the printed copy of your order which contains your personal details as listed above. Your consent to the third party receiving these details is therefore implied.
Waiver: The agreed joint waiver by Wizard Models Limited and any other party of any breach of any of these terms or conditions shall not prevent the subsequent enforcement thereof and shall not be deemed to be a waiver of any subsequent breach.
Jurisdiction: In the case of any disagreement or formal grievance, the binding law applicable to any sale shall be the law of England and Wales, the domicile of Wizard Models Limited. No other legal jurisdiction will be accepted.
Particulars of Ownership: Wizard Models Limited is the parent trading name of Wizard Models, Model Signal Engineering, Sprat & Winkle, D.G. Couplings, 51L, 51L-7, Comet Models, Mainly Trains and Chowbent 4mm. All ten entities are wholly owned by Andrew Hartshorne and in essence synonymous.
